Terms & Conditions

1. Scope

These Terms & Conditions apply to all services of Lyntharis by Lydia Simon (hereinafter "Lyntharis") under the name "Lyntharis Puls": survey services (Puls-Check, Full Employee Survey, Customer Survey, Puls subscription), the Leadership Potential Analysis, and digital products (action Workbooks). The offers are aimed at companies and organisations (B2B).

2. Formation of contract and acceptance of these Terms

  1. Direct online order: for orders placed through the order process on lyntharis.ch, the contract is formed when the order is submitted. The customer immediately receives an order summary with an order number, which can be saved or exported as a PDF. This order summary documents the order; it is not yet a confirmation of receipt of payment. Once payment has been made, the customer additionally receives a confirmation from the payment service provider.
  2. Order by invoice or by quote: if the customer chooses payment by invoice, or if it concerns an offer that cannot be ordered directly (in particular companies with 1,000+ employees and individual requests), the contract is formed by written confirmation of the quote (an e-mail is sufficient).
  3. For digital products (Workbooks), the contract is formed upon order confirmation or delivery of the product by e-mail.
  4. By submitting an order or requesting a quote, the customer accepts these Terms & Conditions; consent is expressly obtained in the order and contact form. The Terms & Conditions are available at any time at lyntharis.ch/agb-en.html.

3. Survey services and customer's contribution

  1. Lyntharis provides the design, execution and evaluation of online surveys as well as the creation of a results report (the "plain-language report") in accordance with the service description on lyntharis.ch. Up to 5 of the customer's own additional questions are included.
  2. The customer provides, in a timely manner: the target-group structure (teams/groups), the desired survey period, and the sending of invitations to participants (templates are provided); the customer informs participants truthfully about the purpose, voluntary nature and anonymity of the survey.
  3. If the customer's contribution is delayed, deadlines are postponed accordingly.

4. Anonymity

  1. Employee surveys are conducted anonymously: no names, e-mail addresses or IP addresses of participants are collected.
  2. Results are only reported for groups with at least 5 responses. Lyntharis declines any evaluation request that would allow conclusions to be drawn about individuals.
  3. Open-text answers are edited before being shared, to the extent they would allow conclusions to be drawn about individuals.

5. Data protection and data processing on behalf of the customer

  1. Insofar as personal data is processed, the customer remains the controller; Lyntharis acts as a processor within the meaning of Art. 9 FADP and processes data solely for the performance of the contract.
  2. Data collection and storage take place on servers in Switzerland (hosting: Infomaniak Network SA, Geneva, as sub-processor). Further sub-processors are only engaged after prior notice.
  3. Lyntharis takes appropriate technical and organisational measures, in particular: no collection of names, e-mail or IP addresses of survey participants, encrypted data transmission (HTTPS), access to raw data restricted exclusively to Lydia Simon via an individual access password, and server-side locking of the data directory against external access. Raw data is deleted 12 months after the survey is concluded; earlier upon request.
  4. Lyntharis may use fully anonymised, aggregated results to maintain industry benchmark values; conclusions about the customer or individuals are excluded. The customer may object to this in writing.

6. Leadership Potential Analysis

  1. The analysis requires the prior, informed and voluntary consent of the person being assessed (a template is provided). No analysis is carried out without consent.
  2. Third-party assessments are collected anonymously and reported only in aggregated form (at least 3 responses per perspective).
  3. The report is a professional assessment and development recommendation; personnel decisions are made solely by the customer, at the customer's own responsibility. The person assessed receives access to their report on request; the customer undertakes to explain the result to them in a personal conversation.
  4. Analysis data is deleted 6 months after completion.

7. Delivery deadlines and Express option

  1. Puls-Check: survey made available within 48 hours; plain-language report within 48 hours of the survey closing.
  2. Full Employee Survey and Customer Survey: made available within 48 hours; plain-language report within 5 business days of the survey closing. For a surcharge of CHF 390 ("Express"), the report is delivered within 48 hours.
  3. All deadlines run from the customer's full contribution.

8. Prices and payment

  1. The prices published on lyntharis.ch at the time of ordering apply, plus any additional services agreed in writing. Lyntharis is not subject to VAT.
  2. Payment is made either online via our secure payment page (Payrexx; credit card, TWINT, etc.) or by invoice within 20 days of delivery of the report or product. For the Leadership Potential Analysis and for large enterprises, a deposit of 50% may be requested.
  3. Discount promo codes are only valid in conjunction with the code issued by Lyntharis and only for the communicated period or purpose; Lyntharis reserves the right not to honour codes that are used improperly.

9. Puls subscription

  1. The Puls subscription comprises four Puls-Checks within twelve months of the first survey, at the published subscription price (around 20% cheaper than four individual bookings). Each measurement includes the full execution, the plain-language report, and, from the second measurement onward, a trend comparison against previous measurements.
  2. The customer determines the dates of the individual measurements; Lyntharis recommends a quarterly rhythm. Measurements not used lapse twelve months after the first survey without refund, unless otherwise agreed in writing.
  3. The subscription does not renew automatically. There is no notice period and no follow-on obligation.
  4. The subscription price is based on the company size stated at the time of ordering. If the company significantly outgrows the booked size category during the term, Lyntharis may propose a reasonable adjustment for the remaining measurements; in this case the customer may terminate the subscription free of charge for the remaining measurements and will be refunded the corresponding share.

10. Pilot programme

  1. Lyntharis may offer pilot places limited in time and number (currently three places for a Puls-Check or a Full Employee Survey at half the published price). Places are allocated in order of receipt; there is no entitlement to a pilot place.
  2. The scope of services corresponds fully to the regular product. There is no reduction in the question set, the evaluation or the report.
  3. In return, the customer agrees to give Lyntharis honest feedback after receiving the report and to allow Lyntharis to name the company as a reference customer. The customer decides whether the mention is made by name or exclusively in anonymised form (e.g. "a fiduciary firm with 30 employees").
  4. This consent is voluntary and may be withdrawn at any time, without giving reasons and without disadvantage to the customer, in writing (an e-mail is sufficient); Lyntharis will then remove the reference from all its own channels within 30 days. The price advantage already granted will not be charged retroactively upon withdrawal.
  5. Individual results, raw data and the content of the customer's report are never published. A reference mention comprises solely the fact of the collaboration and any feedback approved by the customer.

11. Response-rate guarantee

If the response rate is below 50% at the end of the agreed survey period, Lyntharis extends the survey free of charge by up to 7 days and provides an additional reminder template. No further claims exist; sending the reminders is the customer's responsibility.

12. Digital products (action Workbooks)

  1. Workbooks are delivered as a PDF by e-mail. The service is fully rendered upon delivery; there is no right of return. Free preview excerpts are available for review before purchase.
  2. The licence covers internal use within the purchasing company (for the complete set, by all of the company's managers). Passing it on to third parties outside the company is prohibited.

13. Usage rights and trademark

  1. The plain-language report may be used and shared internally by the customer without restriction; external publication of excerpts is permitted with the source credited as "Lyntharis Puls".
  2. Questionnaires, methodology, and report and Workbook formats remain the intellectual property of Lyntharis. Lyntharis® is a registered Swiss trademark (no. 850643).

14. Liability

Lyntharis performs its services with care and to the best of its knowledge. Liability for slight negligence as well as for consequential damages and loss of profit is excluded to the extent permitted by law; otherwise, liability is limited to the value of the order. The results are a basis for decision-making — responsibility for measures taken on this basis lies with the customer.

15. Final provisions

  1. Swiss law applies. The place of jurisdiction is the registered seat of Lyntharis, subject to mandatory places of jurisdiction.
  2. Should individual provisions be invalid, the validity of the remaining provisions shall not be affected.
  3. The German version of these Terms & Conditions is authoritative.

In case of discrepancies between language versions, the German version (agb.html) shall prevail.
